*NCTE के नियमानुसार अध्यापक पात्रता परीक्षा(TET) होना अनिवार्य:*
हाइकोर्ट की लखनऊ बेंच ने *नूतन ठाकुर (MISC.BENCH NO.-2530/2014)* की याचिका में याची की प्रेयर को स्वीकारते हुए TET परीक्षा को NCTE के नियमानुसार न होने पर रद्द करने संबंधी याचिका को फ़ाइल करने की  खुली छूट याची को दी।

```"kindly issue an appropriate writ directing the concerned respondents to immediately quash all the examinations being presently in process for Uttar Pradesh Teacher's Eligibility Test (UP-TET, for short) for language teachers for primary and upper-primary schools for the year-2014 being conducted in flagrant and direct violation of the mandatory requirements prescribed by the National Council for Teacher Education (NCTE, for short) and to accordingly direct the concerned respondents to conduct these UP-TET tests for 2014 and subsequent years only as per all the mandatory requirements prescribed by NCTE, including that provided in the notification dated 11/02/2011 titled "Guidelines for conducting Teacher Eligibility Test (TET)"```
(अर्थात 2014 की प्राथमिक व उच्च प्राथमिक स्तर की टेट परीक्षा रद्द की जाए जो NCTE की अधिसूचना 11/2/11 के नियम के विपरीत थी।)

उपरोक्त याचिका मार्च 2014 में फ़ाइल हुई जिसका फैसला मा0 भोसले साहब की खंडपीठ में 07/09/17 हुआ। कोर्ट ने उपरोक्त प्रेयर को बखूबी स्वीकार किया लेकिन सरकारी अधिवक्ता की दलील कि *2014 के TET पास अभ्यर्थी अध्यापक के रूप में कार्यरत हैं लिहाजा TET रद्द कर उन्हें हटाना उचित नही होगा।* कोर्ट ने मामले को गंभीरता से समझकर TET 2014 को बख्स दिया।

कोर्ट ने लिखा कि...

```He also submits that the State Government had followed in past and shall follow in future all guidelines/mandatory requirements prescribed by the NCTE scrupulously for conducting examinations for recruitment. His statement is recorded and accepted.```
(अर्थात सरकार के अधिवक्ता ने ये स्वीकार किया की उ0प्र0 सरकार भविष्य में होने वाली सभी TET की परीक्षा तय पाठ्यक्रम एवम NCTE द्वारा निर्धारित पाठ्य क्रम के अनुसार करवाएगी।इसे कोर्ट ने रिकॉर्ड में लेकर स्वीकार किया।)

जबकि 2017 में हुई TET परीक्षा तय पाठ्यक्रम से बाहर हुई,मतलब NCTE की नियमावली और कोर्ट के आदेश की खुली धज्जियां उड़ाई गयी।।

इसके बाद अंत मे कोर्ट ने लिखा...

```this petition may be disposed of, with liberty to the petitioner to file fresh petition, if the circumstances so demand or in future, the petitioner finds that the respondents are either not following the guidelines/mandatory requirements prescribed by the NCTE, including that are provided in the notification dated 11.2.2011, or commit any other illegality.```
(अर्थात ये याचिका इस आदेश के साथ निस्तारित करती है कि याची को ये खुली छूट प्रदान की जाती है कि *यदि भविष्य में किसी भी स्थिति में TET परीक्षा NCTE की अधिसूचना 11 फरवरी 2011 एवम तय पाठ्यक्रम पर न हो या किसी प्रकार की अनियमतता हो तो फ्रेश याचिका के माध्यम से कोर्ट आये।*)

यदि उपरोक्त आदेश का संदर्भ ग्रहण करें तो 2017 की TET परीक्षा में न तो पाठ्यक्रम का पालन हुआ और न ही नियमतः काम हुआ।

*जो भी साथी इस 2017 की टेट परीक्षा से प्रभावित हुए हो या उनका व्यक्तिगत हित प्रभावित हुआ हो तो वे संसोधित आंसर शीट जारी होने के उपरांत कोर्ट की इसी आदेश के आधार पर शरण ले,सफलता अवश्य मिलेगी।।।*
